Negotiate and acquire surface and coal leases, fee surface and coal properties, easements and other required property rights necessary for mining operations to be conducted without delays caused by the lack of rights or authority necessary for mining. Draft and review real estate documents. Review title opinions and perform all necessary curative work to properly maintain existing and future surface and coal leases. Coordinate with outside counsel to perform work in other states as needed for our various operations. Work with County, State, and Federal agencies to acquire property rights for NACCO Natural Resources and its subsidiaries.

Job Description:
 

Essential Duties

  • Negotiate for the acquisition of surface and coal leases, fee surface and coal properties, easements, and other agreements, and draft required documents, at operations owned by the Company and its subsidiaries and affiliates, as directed by Management.
  • Conduct title curative activities, draft documents required in curing titles to properties and perform office curative functions and internal records changes based upon title changes.
  • Prepare and update detailed surface and coal ownership title chains through courthouse and online title searches.
  • Update records to reflect ownership and address changes and conduct all other lease and permit maintenance requirements, as requested.
  • Drive a passenger vehicle to landowner residences for negotiations. Drive to county records locations to review and update title.  Maintain a good driving record and valid driver’s license.

Other Duties

  • Work closely with Land Office staff to make sure Land Office records are timely updated and all lease maintenance obligations are met.
  • Other functions and duties as assigned by Company management.
  • Develop and maintain a good communicative and cooperative relationship with mine site managers and staff, especially landowner relations specialists and environmental staff.

Knowledge, Skills, and Abilities

  • Excellent communication, organizational, interpersonal, and negotiating skills.
  • Knowledge of real property law, real estate appraisals, and mineral leasing practices, preferably coal leasing and surface and mineral title issues and laws.
  • Experience running title searches at county courthouses and through online records.
  • Experience with curing title defects and changes in title through ownership changes or other means.
  • Experience maintaining lease and acquisition files is helpful.
  • Skilled in the use of personal computers (word processing, spreadsheet, and electronic mail applications).

Education and Training

Bachelor’s degree and at least three years of directly related work experience, or an equivalent combination of education and related work experience.  Juris doctor degree or other extensive legal education and training a strong plus.  Extensive experience with real estate documents, lease records, title curative activities, conducting negotiations with landowners, and acquiring surface and mineral leases and fee properties.
