Senior Counsel -Employment Law, India

*We are open to hiring in the US or India, wherever RSM has an office.

This role will focus primarily on labor and employment matters. You will also assist occasionally with general corporate, contracting, data privacy, firmwide policies and procedures, litigation and regulatory matters.

Specific duties include:

  • Work with attorneys across RSM’s General Counsel’s office regarding international and country legal strategy.

  • Work with RSM US India leadership to accomplish business objectives.

  • Provide practical, responsive employment legal advice to the business and corporate leadership relating to RSM US India including but not limited to matters related to labor and employment-related matters, hiring, performance management, wage and hour, contingent workforce issues and other employment related matters.

  • Provide advice and help develop strategy on Firm-wide initiatives affecting employees in India.

  • Handle employment related legal matters, including retaining and managing outside counsel involving RSM US India.

  • Manage and monitor litigation and disputes involving RSM US India.

  • Proactively identify and monitor new and emerging legal issues and work with General Counsel’s office team members to effectuate needed changes to business and employment practices.

  • Provide timely information and updates to ensure compliance with changing regulatory, statutory, or best practice guidelines.

  • Assist with the development and implementation of global compliance processes and policies.

  • Assist with policy creation and implementation, and creation and delivery of training programs.

  • Ensure compliance with legal and regulatory requirements and developing policies and procedures to mitigate legal risks.

  • Help drive a culture of compliance and ethics across India consistent with RSM’s Code of Conduct, including assisting with the development of local policies aligned with corporate policies, procedures, and standards.

  • Provide advice and counsel to RSM Global Mobility team on immigration related matters.

  • Advise on investigations including POSH and other grievances including coordinating with the Human Resources team on internal investigations.

  • Assist with corporate secretarial matters and regulatory filings.

  • Assist with reviewing revising general contract templates to conform with India law and local standards.

  • Review, revise, and negotiate vendor contracts.

  • Advise on legal matters related to business operations in India, including but not limited to data privacy, intellectual property, and corporate matters.

Education Qualification:

  • Juris Doctor (JD) degree, with active membership and good standing in the Bar (required for US applicants)

  • LL.B degree and qualification as a registered lawyer in India (required for India applicants)

Required Experience:

  • 10+ years of legal experience within labor and employment law as well as other general corporate law knowledge and experience.

  • Knowledge of Indian laws and regulations related to AI, data privacy, intellectual property, labor, and corporate matters.

  • Proven ability to navigate global employment law issues in India and its various regions, including experience with global investigations, global mobility issues, and global HR compliance issues.

Technical/Soft Skills:

  • Ability to communicate legal requirements and concepts to the business, senior management and Firm leadership.

  • Strong drafting and negotiation skills, with experience in negotiating contracts.

  • Ability to accommodate work hours involving international participant–time zones from multiple continents.

  • Ability to manage multiple projects and prioritize workload in a fast-paced environment and meet deadlines.

  • Excellent communication skills, including exceptional legal writing and verbal skills in English.

  • Demonstrated judgment, personal integrity, and interpersonal skills.

  • Strong ability to work as a team player who can effectively collaborate with colleagues from the Global Legal teams and business stakeholders.

At RSM, an employee’s pay at any point in their career is intended to reflect their experiences, performance, and skills for their current role. The salary range (or starting rate for interns and associates) for this role represents numerous factors considered in the hiring decisions including, but not limited to, education, skills, work experience, certifications, location, etc. As such, pay for the successful candidate(s) could fall anywhere within the stated range.

Compensation Range: $209,300 - $370,700

Individuals selected for this role will be eligible for a discretionary bonus based on firm and individual performance.
