Legal Counsel, Employment (China)
Job Description:
This role will provide legal advice on a broad range of employment law matters throughout the Asia-Pacific (APAC) region, with a strong emphasis on Mainland China. The role will operate out of the Company’s Shanghai Office. This role requires operating with a high degree of autonomy while receiving strategic oversight from a U.S.-based employment attorney. The position is a critical business partner to our Human Resources and business leaders in the region, providing pragmatic, commercially-focused counsel in a fast-paced environment.
What You’ll Be Doing
- Regional Employment Expertise: Advise on the full spectrum of employment law issues, with specific focus on employment agreements, compensation agreements, performance management, employee relations, reductions in force, and contingent labor.
- Legal Counsel Scope: Act as the primary legal contact for employment matters in Mainland China by providing in-depth expert legal advice on the complex and evolving labor laws and regulatory landscape in the country. Facilitate legal counsel support for employment law advice and compliance in Hong Kong and Taiwan.
- Compliance and Risk Management: Develop, implement, and update regional employment policies, practices, and employee handbooks to ensure compliance with all applicable local and international laws. Proactively identify and mitigate legal risks related to employment matters.
- Oversee Investigations of Legal Matters: Lead and conduct sensitive investigations into employee legal complaints of harassment, discrimination, and retaliation across various APAC jurisdictions.
- Strategic Initiatives: Advise and support global and regional strategic initiatives, such as workforce restructuring, mergers and acquisitions (M&A), office expansions, and other corporate transactions, concerning their employment implications.
- Cross-Functional Collaboration: Partner closely with HR and other cross-functional teams to deliver effective and compliant solutions. Collaborate with the broader global legal team to ensure alignment between local implementation and global legal strategies.
- Training and Education: Develop and deliver training sessions on employment law topics for HR and business leaders to build internal expertise and promote best practices.
- Research and Monitoring: Monitor and analyze new and changing labor laws, regulations, and legislative trends, providing timely updates and strategic recommendations to stakeholders.
- Manage outside counsel and litigation. Retain and manage outside legal counsel for employment litigation and specialized legal matters. Monitor adherence to legal budgets and alignment of legal strategies with business objectives.
What We Are Looking For
- Education: Juris Doctor (J.D.) degree or equivalent legal qualification from an accredited institution.
- Experience: A minimum of 5-7 years of experience practicing employment law, with significant experience in the APAC region. In-house experience at a multinational corporation or prior experience at a global law firm is preferred.
- Licensure: Active license to practice law in China. Preferrable if licensed in other APAC jurisdictions.
- Language: Business-level fluency in Mandarin (verbal and written) and English.

- Helpful: Proficiency in Taiwanese Hokkien or Malaysian languages and dialects is a significant advantage for connecting with diverse stakeholders.
- Cross-cultural communication: Excellent verbal and written communication skills with the ability to convey complex legal concepts clearly and concisely to diverse stakeholders.
- Problem-solving: Strong analytical and problem-solving abilities, with the capacity to provide practical, business-focused legal advice and creative solutions.
- Regional expertise: Deep understanding of the diverse and complex employment law landscapes across the APAC region.
