Assistant Insurance Legal Counsel
What the Role is about
The position covers Legal and Regulatory matters in relation to general insurance. The ideal candidate must have a deep understanding of contract law, privacy law, contract management, legal risk mitigation, dispute resolution and regulatory advisory. This role involves providing strategic legal and regulatory guidance on a wide range of insurance related matters, overseeing contractual negotiations, dealing with the regulator, and handling regulatory documentation.
Who You'll Work With
A variety of cohorts and functions across the company, including key stakeholders across Business and Functional Units as well as regional stakeholders. You will report into the Head of Insurance Legal, Malaysia & VIP Cluster.
Key Responsibilities
The Deputy will assist the Head of Insurance Legal on the following matters:
Legal & Regulatory Advisory / Strategy: Provide legal / regulatory advice and strategic guidance to senior management, project teams, business / functional units regarding insurance e.g. applicable BNM Policy Documents and requirements, insurance product and wordings, outsourcing (covering BNM filings for outsourcing and technology related matters), marketing creatives / collaterals, customer correspondences, supporting claim reviews, related agreements, supporting review of complaints, guidance on distribution / agency arrangements, marketing / banca arrangements, regional advisory work etc.
Contract Drafting & Negotiation: Lead the drafting, review, and negotiation of various commercial contracts, including agency agreements, bancassurance outsourcing agreements, data processing agreements, subcontracts, joint venture agreements, HR related agreements / letters and supply of goods and services contracts, assist with the review of policy wordings and endorsements, non-disclosure agreements etc.
Corporate Governance: oversee the company’s corporate governance requirements, including liaising with external Company Secretary and supporting with Board and Committee Meetings.
Dispute Resolution: Manage and resolve disputes related to complaints and/or claims. Advised and support the company in arbitration, mediation, and litigation as required, including managing external counsel with regards to non-claims litigation / disputes.
Legal Risk Management: Identify, assess, and mitigate legal risks associated with the insurance business / proposal. Advise on legal and regulatory matters e.g. relevant BNM guidelines/circulars/policy document.
Training & Development: Provide training and development to internal stakeholders on legal and regulatory issues related to insurance as applicable.
Documentation & Reporting: Maintain accurate records of legal matters and advise on reporting obligations as required by regulatory bodies or stakeholders and assist with the general administration of the Legal Department.
Required Skills and Qualifications.
Education: Bachelor of Laws Degree from a recognized university and admitted as an Advocate & Solicitors of the High Court of Malaya.
Experience: At least 3 years working experience in a legal firm as an Advocate or an in-house counsel of a company, have experience in drafting and vetting of corporate agreements and providing legal opinions and advice, and the willingness to learn. Having industry knowledge is a bonus but not a deal breaker.
PC literate in all MS Office applications and internet savvy
Excellent command of both written and spoken Bahasa Malaysia and English
Excellent interpersonal and communication skills
Resourceful, result-oriented and responsible
Meticulous and able to work independently with minimum supervision
Able to work well in a team and possess pleasant personality
