Job Description:

Rakuten Rewards is seeking a talented brand and marketing counsel to join our legal team in our San Mateo office. In this role, you will serve as the frontline attorney for Marketing (Brand, Creative, and Growth marketing teams) and related intellectual property matters. We are looking for someone who is passionate about working within a fast-paced, collaborative environment, and ready to pitch in and help take our business to new heights.

Key Responsibilities

  • Review, negotiate, and draft a broad range of legal agreements for the Marketing Department including, brand partnership agreements, TV/production agreements, agency agreements, creative services agreements (photography and other custom content), talent agreements, SaaS agreements, technology licenses, and other services agreements.
  • Partner with Marketing (Brand, Creative, Growth, and GTM Strategy), Product, Design, PR/Comms, and legal teams across the company’s multiple business units to support and counsel on brand partnership initiatives.
  • Develop standardization and drive compliance with regional and global requirements and controls related to intellectual property and advertising laws across all the Rakuten Rewards business units.
  • Manage trademark portfolio and relationships with trademark outside counsels to conduct trademark searches and trademark prosecution globally.
  • Provide support and advice with respect to PR releases, advertising, and review advertising claims in promotions/bonuses, marketing assets, and UX flows.
  • Draft and review rules and copy related to contests, sweepstakes, and other promotions.
  • Create and deliver process and trainings for global marketing and advertising law compliance for the business and product and BU counsels, including claim substantiation, competitive and comparative advertising, and regulatory issues affecting regional operations and marketing.
  • Assist in litigation, disputes, and regulatory investigations that may arise in connection or related to company IP, marketing, advertising, and product messaging and affirmative and defense enforcement actions for trademarks, copyrights, and domains.
  • Educate business and legal team members by continuously improving standard form agreements, playbooks, guidelines, and legal processes, including sweepstakes/contests, trademark usage, and branding guidelines.
  • Other duties as assigned by the Director, Associate General Counsel.

MINIMUM REQUIREMENTS (Knowledge, Skills, Abilities)

  • J.D. and admitted to the bar and in good standing to practice law in California
  • 4+ years of relevant experience (may be combined in-house/law firm experience, but at least 2+ years in-house)
  • Strong communications skills, both written and verbal
  • Excellent business and legal judgement
  • Generalist working knowledge with intellectual property law, marketing law, privacy law, and consumer protection laws in the global eCommerce context
  • Ability to work independently and collaborate with cross-functional teams and work in a fast-paced environment
  • Experience in digital advertising, content creation and production, performance marketing, privacy, and/or eCommerce is a plus

At the time of posting, Rakuten expects the base compensation for this role to be within the range shown below. Individual compensation will vary based on job-related factors, including the skills, qualifications, and experience of the successful candidate as well as business need and geographic location. The successful applicant for this role will be eligible for discretionary bonus, health, vision, dental insurance, 401k matching, PTO, Volunteer Time Off (VTO), and other employee benefits as the company implements.

USD $113,157.00 - $211,032.00 annually
