What You’ll Get to Do

Work with client and other team members in support of the DOJ Environment and Natural Resources Division, primarily supporting takings cases, including Rails to Trails related cases. 

Telework is approved, but staff are occasionally needed to work on site if specific tasks require in-person support.

The senior title analyst performs complex legal research; prepares draft legal documents, such as motions, briefs, memoranda of law, etc.; reviews documents for relevance and privilege; and assists attorneys with all phases of litigation, including providing recommendations regarding case strategies and approaches.  The Senior Title Analyst may also act as a team lead for the title analyst and paralegal staff.  This individual may be required to provide testimony at either deposition or trial in support of their research conducted on parcels in dispute in Rails to Trails and other takings cases.

More About the Role

Conducts comprehensive title and deed research and testifies as an expert witness on research and results.  Most common subject matter relates to Rails to Trails, but can include other takings cases.  The principal responsibilities include locating, retrieving, reviewing, organizing, analyzing and summarizing various title documents, which may occasionally require travel to the NARA facilities in College Park, MD, or to the local county offices to manually search and locate relevant documents. 

The title analyst reviews the materials and works with the assigned trial attorneys to determine the legal significance of each document.  Typically the information is managed in Microsoft Excel spreadsheets that summarize the critical contents of the railroad conveyances, including recording information, legal description, and the legal consequences of the document.  This individual must also be able to assist in preparing these documents for use as exhibits for court filings and for trial.  The Title Analyst will need to be able to identify gaps in the historical title record relating to a railroad’s ownership interest, inconsistencies in historic conveyances, and inadequate proof of current landowner’s ownership of adjoining property. In addition to identifying these deficiencies in the above-referenced Excel spreadsheet, the individual will need to convert these deficiencies into narrative form for the assigned trial attorneys’ use in communications with opposing counsel and the court.

This position requires maintaining files in order to provide written and/or verbal testimony regarding the research performed and conclusions reached in the performance of the above tasks. Travel may be required in the performance of the above tasks. Travel is expected to be within the United States, but may occasionally be international.

You’ll Bring These Qualifications

  • Law Degree
  • At least five years of experience working with real estate records
  • Experience as a Title Examiner
  • At least three years of experience on litigation support projects including proven capabilities and communication skills to successfully interact with clients and attorneys.
  • Sound working knowledge of federal and state court systems, legal research procedures, and legal research resources, and thorough knowledge of legal research tools such as LEXIS and Westlaw.
  • Excellent written and oral communication skills
  • Excellent organization skills.  All project related documents and notes must be maintained in an organized system, ready for use and/or production to opposing counsel. 

These Qualifications Would Be Nice to Have

  • In-court trial experience
  • Experience with automated litigation support tools such as Relativity, Trial Director, etc.
  • Experience as or working with expert witnesses
  • Experience with GIS tools valued, e.g., ESRI mapping software
  • Ability to travel

The proposed salary range for this position is:

$62,200-$130,600
