Overview

The Liability Claims Counsel provides legal expertise and strategic guidance in the investigation, evaluation, and resolution of complex liability claims. This role partners closely with claims professionals, underwriting, and senior leadership to mitigate risk, ensure compliance, and drive fair, timely claim outcomes. The position requires strong litigation experience, deep knowledge of P&C insurance, and the ability to balance legal analysis with business objectives.

Key Responsibilities

Claims Handling & Legal Analysis

  • Evaluate complex liability claims, including general liability, auto liability, premises liability, professional liability, and specialty lines as assigned.
  • Provide legal opinions on coverage, liability exposure, damages, and potential defenses.
  • Review and interpret insurance policies, endorsements, statutes, and case law to guide claim strategy.
  • Recommend appropriate claim resolutions, including settlement strategies and negotiation approaches.
  • Assess litigation risk and advise on reserving adequacy.

Litigation Management

  • Oversee and direct outside counsel, ensuring effective litigation strategy, cost control, and adherence to company guidelines.
  • Participate in case strategy discussions, mediations, arbitrations, and settlement conferences.
  • Review pleadings, motions, discovery, and trial preparation materials to ensure alignment with company interests.
  • Evaluate attorney performance and provide feedback to improve outcomes and efficiency.

Coverage & Compliance

  • Analyze and resolve coverage disputes, including drafting coverage position letters.
  • Ensure compliance with state regulations, internal policies, and industry best practices.
  • Assist in responding to regulatory inquiries, audits, and reporting requirements.

Collaboration & Advisory Support

  • Partner with claims adjusters to develop claim-handling strategies and provide ongoing legal guidance.
  • Collaborate with underwriting on policy language, risk trends, and emerging legal issues.
  • Provide training to claims teams on legal developments, litigation trends, and best practices.
  • Support internal initiatives related to risk mitigation, process improvement, and claims governance.

Qualifications

Education & Licensing

  • Juris Doctor (JD) from an accredited law school.
  • Active license to practice law in at least one U.S. jurisdiction.
  • Additional state bar admissions preferred.

Experience

  • 5–10+ years of legal experience, ideally in insurance defense, coverage litigation, or in-house counsel at a P&C insurer.
  • Strong background in liability claims, tort law, and civil litigation.
  • Experience managing outside counsel and complex litigation matters.
