SUMMARY
This position is part of a team of attorneys within the City Attorney’s Office that provides comprehensive legal services to the Aviation Department and works closely with Aviation Department leadership to support safe, efficient operations and ensure compliance with all applicable laws and regulations.
Major Duties and Responsibilities:
Identify and provide legal advice and counsel on complex legal matters, encompassing federal, state, and local law as applied to both general municipal and aviation specific law, and the interaction between those levels of law and those aspects of the business and legal framework of Airport.
Perform complex professional legal research that involves both general and specialized issues; prepares legal opinions for airport staff, including for those in leadership roles.
Ensure compliance with all local, state, and federal laws, with a focus on the numerous regulations and grant requirements that are specific to the airport.
Analyze, develop, and prepare a wide variety of complex legal documents, including the review and/or drafting of legislation at all levels of government.
Advise, assist, negotiate, and draft the process and any necessary documents for procuring contracts, leases, agreements and settlements of all types.
Proactively monitor legal requirements, trends, and issues that impact airport operations and compliance with federal regulations; provide legal assistance to enable staff to develop, recommend, and/or administer policies; monitor changes in policies and practices that have both a legal and operational impact on the Airport.
Represent the City at all levels of federal and state courts, including local boards and administrative hearings, as needed.
Comparison of Senior I and Senior II
Senior I: An experienced attorney who brings extensive legal knowledge in many of the specific practice areas noted above. A Senior I is a skilled attorney who provides forward-thinking practical work product in addition to purely legal work product.
Senior II: An exceptionally experienced attorney that brings extensive legal knowledge in a majority of the specific practice areas noted above, including prior experience with federal law and agencies. Additionally, this level attorney is experienced with the interaction of policy, public, elected officials, appointed officials, and the media. A Senior II must be able to solve issues using practical means in addition to legal means and must be able to independently lead and manage task-specific work groups.
Minimum Qualifications
Juris Doctorate required from an ABA-accredited law school and license to practice law in North Carolina or ability to be admitted into the NC State Bar via reciprocity within six (6) months of hiring date. Minimum years of experience:
Assistant City Attorney Senior I: Seven years (7) of practice experience required
Assistant City Attorney Senior II: Ten years (10) of practice experience is required
Knowledge, Skills, and Abilities:
Considerable knowledge of constitutional, federal, state, and local laws affecting airports and municipal government, including construction.
Ability to work collaboratively with others.
Analyze issues from legal and practical perspectives and provide clear advice and counsel.
Possess business acumen with the ability to negotiate transactions effectively.
Ability to master new material quickly, manage a diverse legal portfolio, and handle a fast-paced environment that is highly regulated on a federal level.
Ability to think creatively to solve problems.
Ability to work independently and exercise sound judgment.
Knowledge of judicial procedures and rules of evidence.
Knowledge of established precedents and sources of legal reference applicable to airports and municipalities.
Ability to prepare and independently try moderately complex civil cases.
Ability to establish and maintain effective working relationships with colleagues, the public, elected and appointed officials, and stakeholders.
Experience with airport-related issues and/or North Carolina municipal law.
Preference for experience with or an interest in learning construction and/or technology-related legal matters.
CONDITIONS OF EMPLOYMENT
The City’s Background Check Policy requires background checks to be conducted on final internal or external candidate(s) applying for any position with the City of Charlotte. The type of information that will be collected as part of a background check includes, but is not limited to: reference checks, social security verification, education verification, criminal conviction record check, and, if applicable, a credit history check, sex offender registry and motor vehicle records check.

The checks must be consistent with the guidelines set forth by these laws requiring organizations to obtain a candidate’s written authorization before obtaining a criminal background report, motor vehicle records check or credit report; and to properly store and dispose of information derived from such reports.
Final candidates must pass a pre-employment drug-screening test and physical examination. During the selection process, candidates may be asked to take a skills test, and/or participate in other assessments.
