We are seeking a highly motivated Brand Protection Lead focused on the Brazilian market with potential regional support. This role contributes to the protection of FMC, our growers and the environment by identifying, assessing and mitigating risks related to brand infringement, counterfeiting, and in-market threats. The selected candidate will work closely with Industry associations, Law enforcement and collaborate internally with FMC Legal, Regulatory, Commercial and Supply Chain teams to support robust enforcement against illicit trade threats.

Key responsibilities:

1. Gather threat intelligence on illicit production and distribution impacting the Diamide and growth portfolios (Isoflex®, Dodhylex® & Fluindapyr).

  • Assess identified threats and engage with the Global Brand Protection team, Legal, Regulatory, Marketing & Sales to help develop considered and proportionate responses.
  • Work closely with the Global Head of Brand Protection to investigate leads generated as part of global intelligence gathering efforts and ensure that all in-country activities are consistent with the global strategy.
  • Develop relationships with key industry players to assist in intelligence gathering and enforcement activities.
  • Conduct Market surveys and monitor Online marketplaces and social media to identify illicit activity impacting FMC.

2. Oversee investigations into potential breaches of FMC intellectual property rights identified in the market.

  • Manage investigations, sample collection and appropriate follow up activities into identified cases of “counterfeit” (fake) FMC products, those that infringe our Registered Trademarks or are otherwise illicit.
  • Ensure all investigations and operational activities undertaken by, and on behalf of FMC are ethical, reasonable, proportionate and strictly adhere to local compliance requirements and global best practices.
  • Liaise with Legal and Regulatory colleagues to instigate enforcement actions by local authorities, in line with pre-agreed criteria for such actions. Ensure Legal oversight and operational compliance.
  • Represent FMC by actively participating in the CropLife Brazil Anti-Counterfeiting Committee.

3. Internal reporting and communications.

  • Prepare reports on intelligence gathering and investigation activities at a regular frequency, to ensure relevant functions are informed of developments, potential impacts, planned courses of action and expected outcomes.
  • Ensure internal investigation case management system is kept updated with market intelligence, investigation progress and enforcement outcomes.
  • Work with Corporate Communications on awareness campaigns which increase reports of suspicious products from the field. Reinforce the See It – Report It! online reporting initiative.

Requirements:

  • Bachelor’s degree in Business, Marketing, Data Analytics, or a Technical discipline, such as Chemistry, Engineering or Agricultural Sciences combined with commercial and/or market research experience is desired.
  • Proficient in Portuguese and English, both written and spoken. Spanish language skills a plus.
  • Prior Brand Protection, Corporate Security Investigations, IP Enforcement or Market Research experience would be a strong advantage.
  • Experience in the agrochemicals or other highly regulated industry (such as Pharma) is preferable.
  • Familiarity with Open-Source Intelligence collection techniques and an understanding of Intellectual Property are preferred.
  • Strong interpersonal and organizational skills including critical thinking and assessment, problem solving, negotiating, managerial courage, composure, consistency and organizational agility.
