Job Description:

Accountabilities

Master contractual documents and lead the project team in their analysis and interpretation;

• During Project Planning phase, support the project team members in the detailed and complete review of the Project (scope of work, economic and financial conditions, contractual terms and conditions, etc.);
• Support the project team with contract management activities during project execution (incl. identification and resolution of main contractual issues, claims and disputes in accordance with contractual provisions, development of appropriate mitigation strategies, action plan definition, providing contractual clarification / position to project’s team members);
• Ensure monitoring and reporting on the project's contractual and commercial risks and support the identification of opportunities and risk mitigation strategies;
• Ensure the definition of the commercial change management and claims strategy;
• Ensure establishing sustainable customer relations in ensuring positive and expeditious resolution of claims;
• Support the PM with the preparation of variation offers to the customer, assessing their contractual impact, and with the following negotiation;
• Ensuring the maintenance of contractual records and documentation (all contract correspondence, contractual changes, status reports...)
• Support project team members to identify which customer contractual conditions are to be flowed down into sub-supplier contracts;
• Support the PM in managing contractual relations with customer and eventual partners;
• Analyze and provide judgement in relation to claims or complaints from the customer and/or partners, liaising with Legal when necessary;
• Supporting assigned project team members in managing subcontracts (e.g. reviewing of subcontractors monthly progress claim)
• Ensuring Claims preparation support and managing disputes in accordance with the contract provisions;
• Ensuring contractual aspects of contract close-out, extension or renewal are properly implemented;
• Participate in contract review during Bidding phase.

Job requirements

Required Skills/ Knowledge

• Minimum 3 years of contract/commercial management experience (preferably in construction projects)
• Experienced in dealing with external stakeholders (Clients/ Main Subcontractors)
• Risk Management Experience
• Contract Management Experience
• Excellence in Achieving Assigned Objectives
• Experience in the rail sector highly appreciated
• Experience/skills in Project Management or similar role will be considered
   

Education / Qualifications

Bachelor's Degree in Engineering/Law/Business Administration

Specialization in Construction Law/Business Administration will be considered

Languages

Spanish mother tongue or fluent

Conversational English level
