In support of PJM's Vision and Mission, the Counsel/Senior Counsel will develop, communicate and implement effective regulatory communication to advance PJM's growing, complex, exciting and progressive business agenda before the Federal Energy Regulatory Commission (the "Commission").The Counsel/Senior Counsel will have primary responsibility for executing PJM's regulatory strategies.The Counsel/Senior Counsel will manage outside legal resources and non-lawyer professionals and engage in hands-on regulatory practice before the Commission.The Counsel/Senior Counsel will assist the General Counsel and executive management in formulating PJM's regulatory strategies and, with the General Counsel, will counsel business managers, executive management and the PJM board on regulatory developments.The Counsel/Senior Counsel is expected to follow closely decisions and policy at the Commission and will assist the General Counsel in communicating such developments to the PJM membership.
Essential Functions:
Analyze, interpret, advise and provide recommendations on legal matters involving PJM.
Responsible for formal advocacy before the Commission; custodian of all formal communications made to the Commission.
Drafting, editing and electronic filing of certain PJM pleadings, including interventions, comments to NOPRs, comments and compliance filings on discrete matters.
Direct and manage outside counsel on the drafting of other PJM pleadings; direct and manage outside counsel in discovery and hearing phases of adversarial Commission proceedings.
Organize the argument and approach with outside counsel of pleadings in more substantial and/or adversarial the Commission proceedings.
Review, edit and revise draft pleadings prepared by outside counsel.
Collect input and comment on draft pleadings (including those prepared by outside counsel) directly from business clients and either incorporating them into the drafts or coordinating an organized response back to outside counsel for incorporation into the drafts.
Appear as counsel of record on PJM matters before the Commission.
Coordinate responses to discovery requests when received by PJM and the propounding of discovery on PJM’s behalf.
Attend the Commission hearings, settlement conferences, open meetings, technical conferences, etc.
Monitor and keep up with the Commission decision making in other areas that might impact PJM business.
Responsible for coordinating litigation proceedings in local, state and federal courts involving PJM.
Act as the liaison on regulatory and legal issues with PJM stakeholders.
Counsel and advise management and staff on tariff compliance and other regulatory issues.
Participate in discussions to develop policies affecting PJM.
Provide legal advice and interpretations of PJM’s tariff and other governing documents.
Quickly develop sensitivity to varied business and operational interests and ability to apply substantive knowledge of applicable law and seasoned legal judgment to promote objectives of in-house client base.
Characteristics and Qualifications:
Required:
JD degree
5+ years of work experience
Ability to produce high-quality work products with attention to detail
Experience with legal research and writing
Experience in litigation matters
Experience working with a regulatory agency, law firm or in a legislative setting
Preferred
MBA, Business Administration
Experience with PJM Agreements and Tariffs
Experience with PJM operating agreements and neighboring systems
Experience with PJM operations, markets, and planning functions
Experience assisting in the preparation and filing of documents in federal or state regulatory proceedings
Experience with PUC and state regulatory laws, coupled with a general understanding of the electric utility industry
