About The Team And The Role:

The Senior Counsel, eDiscovery & Data Governance will play a meaningful role in crafting and delivering eBay’s global strategy for eDiscovery, data governance, and information lifecycle management. As part of the AI & Data Governance team, this role will provide strategic legal counsel and operational leadership across litigation, regulatory matters, and enterprise data initiatives!

This attorney will partner cross-functionally with Litigation, Legal Analytics, Compliance, Privacy, Global Information Security, and People Experience to ensure that eBay’s data practices are legally defensible, operationally efficient, and aligned with evolving regulatory expectations. The role will lead development and execution of discovery strategy in high-stakes litigation and investigations, including oversight of defensible data collection, large-scale document review, and the use of technology-enabled solutions to drive efficient, reliable outcomes.

This position will advise on data-related aspects of current and new technology implementations, data handling, data transfers, retention and deletion considerations, as well as M&A activities related to defensible data separation and integration. The ideal candidate brings a forward-looking approach, using automation, analytics, and process optimization to improve legal outcomes and reduce risk and cost.

What You Will Accomplish:

  • Advise and lead all aspects of eDiscovery strategy, including defensible collection of documents, data sets, and other evidence across litigation, regulatory matters, and investigations

  • Lead and coordinate large-scale document reviews, using technology and analytics to drive efficiency, accuracy, and cost-effectiveness

  • Develop, track, and report on KPIs related to discovery performance, including cost savings and cost avoidance

  • Advise on and assist in operationalizing an enterprise-level data governance, records management, and defensible deletion practices

  • Draft, update, and deliver training on legal hold, records retention, and data governance policies and procedures

  • Oversight and continued development of enterprise legal hold processes that ensure timely, defensible preservation of data and effective compliance in litigation and regulatory matters.

  • Provide global, enterprise-wide advisement on legal records retention and deletion practices and policies and lead continuing evolution of eBay’s Global Records Retention Policy and Schedules to align with emerging laws and expanding business models, services, and capabilities 

  • Partner with cross-functional participants to ensure scalable, compliant data lifecycle management practices

  • Counsel on risks related to data handling and new technologies

  • Support M&A activities, including data diligence, separation, and integration

  • Drive adoption of innovative, technology-enabled solutions (e.g., analytics, automation, TAR) to improve legal and operational outcomes

What You Will Bring:

  • J.D. from an accredited law school and an active license to practice law in at least one U.S. state

  • 7+ years of experience in eDiscovery, complex litigation, and records and/or information governance

  • Deep understanding of discovery processes, including collection, review, and production, and associated technologies

  • Experience leading extensive document reviews and discovery vendors

  • Proven understanding of data lifecycle management, records retention, and justifiable removal

  • Experience advising on technology and data-related risk

  • Proven track record to operate at both strategic and operational levels in a fast-paced, global environment

  • Strong analytical approach, including experience developing metrics, benchmarks, and cost management strategies

  • Excellent judgment, communication skills, and ability to influence cross-functional collaborators

  • Proven track record using AI tools and capabilities to incorporate AI into workflows

Preferred Qualifications

  • Law firm or related regulator/government experience in end-to-end litigation

  • Experience/knowledge of payments related records and compliance requirements

  • Proficiency in document review platforms

  • Firm understanding of technology, backend data storage and data flows in a sophisticated data environment/architecture

  • Knowledge and command of privacy laws/requirements

Additional Details

The base pay range for this position is expected in the range below:

$135,200 - $219,500

Base pay offered may vary depending on multiple individualized factors, including location, skills, and experience. The total compensation package for this position may also include other elements, including a target bonus and restricted stock units (as applicable) in addition to a full range of medical, financial, and/or other benefits (including 401(k) eligibility and various paid time off benefits, such as PTO and parental leave). Details of participation in these benefit plans will be provided if an employee receives an offer of employment.

If hired, employees will be in an “at-will position” and the Company reserves the right to modify base salary (as well as any other discretionary payment or compensation program) at any time, including for reasons related to individual performance, Company or individual department/team performance, and market factors.
