Title: Lead Counsel – Data Strategy, Governance & Emerging Technology

Location: Remote

The Role 

McKesson’s well-regarded General Counsel’s Organization is seeking an experienced, pragmatic attorney specializing in data enablement, privacy, and emerging technology to provide decisive legal leadership and strategic advice on McKesson’s data initiatives across its broad portfolio of healthcare-oriented businesses.

The Lead Counsel, Data Strategy, Governance & Emerging Technology, will be pivotal in McKesson’s risk mitigation and value-generation strategies. Reporting to the Managing Chief Counsel, Enterprise Data Privacy, Security and Technology Law, this role will focus on enterprise-level data initiatives while solutioning for nuanced data use cases, prevailing privacy requirements, and evolving technology capabilities, including Artificial Intelligence (AI).

This position requires a dynamic leader who will proactively collaborate with business unit attorneys and business executives at the highest levels across the enterprise to drive innovation while adeptly managing risk within the highly regulated healthcare industry.

Key Responsibilities 

The successful candidate will:

  • Innovate and Drive Change. Leverage deep knowledge and experience in data strategy and enablement, privacy (including experience with HIPAA/healthcare privacy issues), and various emerging technology laws and regulations to deliver actionable, risk-based guidance to the enterprise.
  • Provide Strategic Counseling. Offer excellent legal judgment and communication skills while providing pragmatic, business-oriented advice, and strategic insights to support the enterprise’s data-driven objectives and priorities.
  • Collaborate and Influence. Work independently and collaboratively across multiple businesses and stakeholders to drive organizational change while considering the broader implications to business unit/functional areas.
  • Navigate Complexity. Skillfully navigate a highly matrixed organization, building relationships across the enterprise and influencing at the highest level to drive results.
  • Lead and Execute. Ability to execute enterprise-level data initiatives by addressing novel and complex legal issues, serving as a key leader on project teams, and ensuring accountability.
  • Integrate and Align Data Strategies. Integrate and harmonize business unit data priorities with the enterprise data strategy to provide solution-oriented and data-enabling guidance.
  • Manage Multiple Priorities. Be highly proactive, accountable, team-oriented, and capable of managing multiple competing priorities in a fast-paced, dynamic environment.
  • Monitor and Adapt to Evolving Laws. Stay abreast of evolving laws, regulations, and industry best practices to guide the enterprise through evolving requirements and external influencing strategies

Qualifications 

Minimum Requirements 

  • 8+ years as a practicing attorney with firm and/or in-house experience
  • 5+ years of specialized experience in data strategy and enablement, privacy, and/or technology law
  • Member of a U.S. state bar in good standing

Critical Skills

  • Experience advising both business and legal leaders on complex legal, regulatory, and policy questions in the areas of data strategy and enablement, privacy, emerging technology law, and data governance.
  • In-depth expertise on HIPAA and other healthcare privacy laws with an emphasis on data rights, data enablement and data strategy. Detailed knowledge of a broad range of additional privacy and data protection laws including, the FTC Act, TCPA, biometrics laws, federal cybersecurity laws, evolving AI laws and regulations, state consumer protection laws, state breach notification laws and laws impacting employee data.
  • Experience conducting privacy, cybersecurity, and technology-focused legal reviews of new or existing technology, services, and product offering with the ability to quickly learn (often self-teaching) technical concepts.
  • Advanced knowledge of trends and issues applicable to privacy, cybersecurity, artificial intelligence, and emerging technology arenas. This includes knowledge of such concepts as data strategy, data optimization, data enablement, data localization, and data rights contracting.
  • Possess well-developed insights on emerging technology to include AI/machine learning, generative AI, and data privacy-enhancing technologies such as synthetic data, tokenization, and anonymization/de-identification.
  • Experience leading and/or supporting the development of strategic data governance frameworks and their associated rollouts across a complex enterprise with various and diverse sub-business organizations.
  • Ability to monitor and evaluate evolving laws, regulations, and industry best practices to help the enterprise navigate new requirements against both existing and anticipated business models.  This includes the ability to guide the enterprise toward opportunities, including reviewing, advising, and supporting data rights strategies and/or advising on external influencing approaches.
  • Capable of handling significant legal issues, disputes, or transactions at the highest level. Experience managing outside counsel, as necessary.

Additional Knowledge and Skills

  • Experience counseling major corporations in the healthcare industry on data initiatives, with the ability to cultivate and maintain robust existing relationships with industry stakeholders.
  • Proven track record of successfully navigating emerging areas of privacy and technology law and building effective data enabling frameworks.
  • Ability to provide strategic legal advice from a data strategy and enablement privacy, cyber, and technology law perspective in various complex business transactions. This includes performing legal due diligence, recommending appropriate post-integration actions, and drafting and negotiating relevant language in M&A-related contracts and documents.
  • Ability to effectively and efficiently collaborate with internal stakeholders to support due diligence, analysis, preparation, drafting, and/or negotiation of pertinent third-party business arrangements, intercompany agreements, and ad hoc contractual provisions related to privacy, cybersecurity, and other technology laws.
  • CIPP/US, and/or similar professional certification(s).

Education

  • Juris Doctor degree with excellent academic credentials

Physical Requirements

  • General office demands.
  • Must have the ability to travel up to 25% of the time.

Our Base Pay Range for this position

$155,900 - $259,900
